Presenter: Ian Horak – Barrister, Victorian Bar

The Intellectual Property Laws Amendment (Raising the Bar) Act 2011 (Cth) implemented one of the most significant changes to patent law since the Patents Act 1990 (Cth) came into force.  This seminar discusses the impact of those amendments four years on and will consider, in particular, how changes have impacted patent applications and granted patents which are the subject of post-raising the bar provisions. In particular, the seminar will explore whether the bar really has been raised, how and what are the potential grounds of invalidity that arise as a result of those amendments.

The duration of the seminar will be approximately 1 hour.

 

About the presenter:

Ian is a barrister at the Victorian Bar and has been since 2003.  He is also a registered Australian Patent and Trade Marks Attorney (with technical qualifications in Chemical Engineering), having completed his patent attorney qualifications at Phillips Ormonde & Fitzpatrick in 2002.

Ian practises exclusively in intellectual property law and regularly appears before the Federal Court of Australia and the Australian Patent and Trade Marks Office. He has appeared in many cases involving patents including in the High Court of Australia in one of the seminal cases on inventive step (AstraZeneca AB v Watson Pty Ltd) and in the Full Federal Court in RPL Central, which determined the patentability of computer implemented inventions.
