Australia is one of the few countries in the world which offers defensive trade mark registration. Defensive registration is available for trade marks for goods or services for which the mark has not been used – even if there is no intention to ever use the mark in connection with those goods or services.

The system of defensive registration is not limited to “famous” trade marks and the defensive registration provisions of the Trade Marks Act are under-utilised by trade mark owners. Defensive registrations are not vulnerable to removal on non-use grounds.
