Just over a year ago, the Full Federal Court of Australia confirmed that unpatentable abstract ideas or business schemes do not become patentable merely by being implemented on a computer. Nonetheless, this judgment (the RPL Central judgment) provided that computer implemented inventions can still be patentable if the computer is ‘integral’ to the invention and if the computer functions in the nature of an adviser or an artificial intelligence.

At this seminar, Mark Williams will look at a number of related topics including:

  • a brief history of the patentability of computer implemented inventions in Australia
  • how RPL Central has been applied in practice at the Australian Patent Office
  • recent practical examples of types of inventions that have been held patentable/non-patentable subject matter before the Australian Patent Office
  • tales from the ‘patent office examination trenches’ over the last year
  • tips for drafting patent specifications for computer implemented inventions in Australia.

The duration of the seminar will be approximately 1 hour.

About the presenter:

Mark Williams is a patent and trade marks attorney and a Senior Associate of Phillips Ormonde Fitzpatrick. Mark has over 15 years’ experience in drafting and prosecuting patent applications in the fields of electronic devices, electronic gaming machines, online transactions and payment systems, anti-virus software, computer implemented inventions and mobile 3GPP/LTE standards.
