Trade Marks in the age of Google

The increase in businesses using the internet to promote their products and services has prompted corresponding growth in the ways in which trade marks may be used and abused online.

At this seminar, we look at the recent Federal Court case of Veda Advantage Limited v Malouf Group Enterprises Pty Limited, where the Court considered whether unauthorised use of trade marks, including as key words in Google AdWords, constituted trade mark infringement and misleading and deceptive conduct.

About the presenter:

Malcolm Bell is an intellectual property lawyer and registered patent and trade marks attorney, as well as a Partner of Phillips Ormonde Fitzpatrick and Phillips Ormonde Fitzpatrick Lawyers. Malcolm’s patent attorney practice includes all aspects of patent, trade mark and design work, including drafting patent specifications, prosecuting patent and trade mark applications and providing infringement and validity advice. Malcolm is also experienced in running opposition matters before both the Patent Office and Trade Marks Office, including appearing as an advocate.
