What is a Plant Breeder’s Right?
Registering a PBR grants intellectual property protection to the new variety.
Plant Breeders Rights
The breeder of a new plant variety can register it in Australia under the Plant Breeder’s Rights Act 1994. The PBR scheme encourages innovation in plant breeding by granting exclusive rights to the breeder of a plant variety provided it is new, distinct, uniform and stable.
Registering a PBR grants intellectual property protection and prevents others from selling, reproducing, conditioning the material for propagation and importing or exporting the registered variety. The breeder may also sell their rights in the variety, or transfer them, for example to a company.
