What can be Patented?
Different countries have different laws about what constitutes patentable subject matter. Generally, most countries will not grant a patent for a mere discovery, scientific theory, mathematical method or a method for performing a mental act.
Some countries also exclude commercial or business methods, naturally occurring substances and methods of medical treatment (as opposed to medical products).
Under Australian law, patentable subject matter includes a “manner of manufacture” in a field of economic endeavour. The categories of inventions that met the “manner of manufacture” test have expanded over time.
