This allows us to provide React members a variety of anti-counterfeiting services and facilitate the enforcement of our local clients’ intellectual property rights in Europe.
 

Customs

Working with Customs and Border Protection Service in Australia and New Zealand is a cost-effective strategy to enforce your IP rights and capture counterfeit goods as they enter the country.

Before Customs Officers can look for and seize suspected counterfeit goods as they enter the country, it is necessary to lodge a notice. Such a notice can be lodged in respect of registered trade marks or copyright both in Australia and New Zealand.

In addition to assisting clients by preparing and lodging notices, we work with Customs to help them identify suspected shipments or importers and determine whether goods are counterfeit and can therefore be seized.

We then follow up with importers to seek forfeiture of the goods.

A key to a successful seizure program is a good working relationship with Customs and increasing Customs’ awareness of potentially infringing goods. We regularly conduct training sessions of Customs officers in each of the major ports of importation into Australia.
 

Investigations

We are able to conduct investigations on a specific retailer or importer in Australia and organize test purchases through our licensed investigation company, IP Organisers.

The Phillips Ormonde Fitzpatrick Group is the only Australian IP firm with a licensed investigator in-house.

This ensures that we are able to obtain evidence in an appropriate manner so that it can be relied upon if it is necessary to bring a Court action.

We can also help your company put in place a market watch program to monitor the presence of counterfeit items on markets around Australia.
