Overview

A trade mark is any "sign" which is used to distinguish the goods or services of one business from the goods or services of any other business. Most trade marks are words or logos, but sounds, shapes, colours and scents are examples of other things which can be trade marks.

Trade mark laws throughout the world are not harmonised, and a separate trade mark registration is usually required for each country in which trade mark protection is desired.

Regional trade mark registrations are available in some areas such as Europe. It is possible to obtain a single international registration covering more than 70 countries which are members of the Madrid Protocol, but some of Australia's major trading partners are not members of the Madrid Protocol.

We assist businesses to obtain trade mark registrations by preparing and filing trade mark applications, responding to examiners' reports and oppositions raised by other persons, managing the complexity of multiple applications in multiple countries, and managing the payment of renewal fees and other government taxes.

Through our associated law firm Phillips Ormonde & Fitzpatrick Lawyers we provide litigation, licensing and other legal services, and through our associated company IP Organisers Pty Ltd we provide portfolio management and research services including trade mark searching.
