| The Australian Government has agreed to amend the Patents Act to define an experimental use exception. The amendment will clarify the kinds of research activities that can be done without infringing on a patent holder's rights, such as: determining how an invention works; determining an invention's scope; determining the validity of patent claims; or improving an invention. The amendments are part of the Australian Government's response to recommendations from the Advisory Council on Intellectual Property (ACIP) report: Patents and Experimental Use. |
